1. Introduction
Welcome to Damanos Company, we, our, us. These Terms of Service Terms govern your use of our website, marketplace, and logistics services collectively, the Services. By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
2. Account Registration
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during the registration process.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3. Logistics Services
Damanos acts as a freight forwarder and logistics platform. We facilitate the movement of goods but are not the actual carrier unless explicitly stated in a separate agreement.
- Customs: You are responsible for all customs declarations and duties.
- Insurance: Cargo insurance is optional and must be requested in writing.
- Delays: We are not liable for delays caused by port congestion, weather, or force majeure events.
4. User Responsibilities
You agree not to use the Service to ship prohibited items, including but not limited to hazardous materials (without proper documentation), illegal drugs, weapons, or counterfeit goods. Violating this policy will result in immediate account termination and reporting to relevant authorities.
5. Payment Terms
All fees are quoted in USD unless otherwise stated. Payment is due upon receipt of invoice. Interest of 1.5% per month may be charged on overdue accounts. In the event of non-payment, Damanos reserves the right to exercise a lien on any cargo in our possession.
6. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Damanos and its licensors. The Service is protected by copyright, trademark, and other laws of both the Pakistan and foreign countries.
7. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
8. Limitation of Liability
In no event shall Damanos, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
